The Housing Grants, Construction and Regeneration Act 1996, Part II, sections 109 to 111, as amended by the Local Democracy, Economic Development and Construction Act 2009, sets the payment regime for construction contracts in the UK. Each contract must fix a due date and a final date for payment. The payer serves a payment notice stating the sum considered due and the basis of the calculation; to pay less than that notified sum, a pay-less notice must be served before the prescribed period ends. If neither notice is validly served in time, the sum in the payee's application becomes the notified sum and is payable. Where the contract does not comply, the Scheme for Construction Contracts (England and Wales) Regulations 1998 supplies the missing terms. JCT and NEC4 set different periods again, which is precisely why a single hard-coded payment period is a red flag rather than a simplification.
